End User License Agreement

MAKE SURE TO READ THESE TERMS OF SERVICE ("EULA", OR "AGREEMENT" OR "TERMS OF SERVICE", OR "TERMS", OR "TERM" OR "CONTRACT" OR "TOS") (COLLECTIVELY "SERVICE"). BY COMPLETING THE REGISTRATION PROCESS, AND/OR USING THE SITES OR SERVICE IN ANY MANNER, INCLUDING BUT NOT LIMITED TO VISITING OR BROWSING THE SITES, YOU REPRESENT THAT (1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT, (2) YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH THE COMPANY, AND (3) YOU HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT PERSONALLY OR ON BEHALF OF THE COMPANY YOU HAVE NAMED AS THE CUSTOMER, AND TO BIND THAT COMPANY TO THESE TERMS.  THE TERM "YOU" REFERS TO THE INDIVIDUAL OR LEGAL ENTITY, AS APPLICABLE, IDENTIFIED AS THE CUSTOMER WHEN YOU REGISTERED FOR THE SERVICE. THIS AGREEMENT APPLIES TO ALL USERS OF THE SITES OR SERVICE, INCLUDING USERS WHO ARE ALSO CONTRIBUTORS OF CONTENT, INFORMATION, AND OTHER MATERIALS OR SERVICES ON THE SITES.  

IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, YOU MUST NOT ACCESS OR USE THE SITES OR THE SERVICE.

- Modification of these Terms of Service

The Company reserves the right to update and change these Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall automatically constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at the current web page.

- Registration, customer account and login

When You register to our Service, You need to provide your valid email address (disposable emails are NOT allowed) and a password of more than 15 characters. You must provide your real information and You are responsible for all the information inserted in the registration form. After You have successfully registered to the Service, you have created a so called "Account" or "Customer Account" with the Service. The Service may send you an email with a link that you should click to activate your email address. Only after you have confirmed your email you will be able to login to the dashboard.

If You provide any information that is untrue, inaccurate, not complete or incomplete, or the Company has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Company has the right to suspend or terminate your account and to refuse any and all current or future use of the Service (or any portion thereof) by You. You agree to maintain and promptly update your registration data to keep it true, accurate, current and complete.

Your IP address used during the registration will be saved in the database of the Service and will help the Company to respond to abuse requests. Also when You login to the Service, Your IP address is saved in the database of the Service. Your email address cannot be changed from the user's control panel, You will need to contact the Company by email, using Your email used during the registration, and ask the Company to change Your email address. 

Accounts registered with robots, bots or other automated methods are not permitted and may be disabled and/or deleted without notices. You are responsible for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account or any other breach of security. You acknowledge that you should always logout from your account at the end of each session, for security reasons. You agree that you are responsible for any losses arising out of the unauthorized use of your account.

Your account may be used by multiple people, the Company is not responsible for the activity of users on your account. You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all Content and activity that occurs under your account (even when Content is posted by others who have accounts under your account).

- Usage of the Service as a registered user

CAREFULLY BEFORE USING THE APP.APIVOID.COM SERVICE OFFERED BY NOVIRUSTHANKS COMPANY SRL ("COMPANY", "NOVIRUSTHANKS", "WE"), WITH  HEAD OFFICE IN PG (ITALY), C.F. & P.IVA IT03065920542. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE APP.APIVOID.COM SERVICE AND WEBSITE OWNED AND OPERATED BY THE COMPANY , INCLUDING, WITHOUT LIMITATION, THE APP.APIVOID.COM WEBSITE ("SITES", "SITE"), AND ANY OTHER FEATURES, CONTENT, OR APPLICATIONS OFFERED FROM BY APP.APIVOID.COM 

The Service is related to usage of apivoid.com (and its services)

The Service is licensed, not sold.

We do not guarantee that the Service will have a 100% uptime or any other percentage.

Subject to Your compliance with the Terms, the Company grants You a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service during and for the terms for which you have purchased the Service. 

We provide You, as a registered user, the possibility to query, using an API key associated with Your account, our service. When you execute 1 (one) query to the Service it is considered 1 (one) request and the available credits are decreased by specific API credits (depends on the API service you used). If the API endpoint returns an error, the API credits count is not decreased. When you request information about the remained credits using the API key, the available credits are not decreased. 

You can purchase credits with the pay-as-you-go plan, so if you need N credits, you purchase only the needed credits (there are no recurring or hidden fees) and you can use the purchased credits when you need. However, take in mind that credits need to be consumed within 1 year.

*Here is what you cannot do with the Service:

[1] You cannot share the API keys associated with your account with persons that are not part of your company or that are not your colleagues. 
[2] You can not share the API keys associated with other accounts with others or third-parties. 
[3] You can not make the API keys public (such as posting the API keys to forums, blogs, social networks, comments, etc.).
[4] You must not use the Service for any illegal or unauthorized purpose. 
[5] You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 
[6] You can not use the Service for unethical purposes or for any purpose that could be prejudicial to the Company, or to other companies or businesses. 
[7] You cannot use the Service to compare other software and/or services.
[8] You abstain from any activity that could damage, overload, harm or impede the normal functioning of the Service. 
[9] You cannot use our APIs to create a clone or competitor of our service.
[10] You cannot use our APIs to create a service that works like URLVoid.com service.
[11] You need to give credits to our service where you use our APIs.
[12] The service cannot be white labeled.

*You can view and memorize/store the results generated by the Service ("Details"), but:

[1] You can not use the Details of the Service to compare other software or services.
[2] You can not use the Service for deceptive means to discredit or as bait to prove some concept regarding other services and\or software.
[3] You can not use the products, services, contents or tools provided by the Company in any way that could harm other entities, whether it is directly or indirectly. 
[4] You can not use the products, services, contents or tools provided by the Company for illicit, unethical or fraudulent purposes

*Usage in commercial services and products

You can integrate the Service in your commercial services or products.

- Data submitted on our service

When you submit something on our API service (such as a domain or a URL) you grant us the rights to do anything with that data, we will however never store or share email addresses or IP addresses (that we consider as sensitive information). Regarding URLs and domain names (such as google.com or subdomain.google.com) submitted in our APIs, we may (but have no obligations) save, share or resell them to cybersecurity companies or other companies. This is done to improve other security services, to detect new threats and for analysis purposes. 

When you submit an IP address we will not store or share it, when you submit an email address we will not save or share the email address, but we may extract the domain name (such as gmail.com) and share it. When you submit a URL, domain or IP address that is scanned with multiple blacklist engines (such as on IP Reputation API or on Domain Reputation API) then you acknowledge that your sent data (such as the domain or the IP address) may need to be forwarded to some external blacklist engines (such as Barracuda_Reputation_BL, BlockedServersRBL, IBM_Cobion, JustSpam_org) and that they may treat the data according to their privacy policy and data processing policy. If you don't want this to happen, you can exclude the blacklist engines that require us to send them the domain or IP address (contact us for the list) by using a HTTP GET parameter "&exclude_engines=" that we provide on APIVoid APIs (see the APIs documentation page) and thus the submitted IP address or the domain will not be forwarded to external blacklist or DNSBL engines. 

Regarding location of our servers and thus where the data submitted to our APIs is processed, we use Google Cloud (US), Hetzner (DE, FI) and Scaleway (FR). Please note that as wrote above, we do not store or share data submitted to our APIs, except for URLs and domain names like gmail.com or google.com, that we may store them and share them with cybersecurity companies. We may temporarily store the HTTPS API requests data in Google Stackdriver for diagnostic and statistical purposes ,such as to check if there are issues on our service or to view statistics about HTTPS API requests in the last 24 hours, for example.

- Cancellation and termination of the account

You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time by contacting the Company via email and providing the required credentials and other requested information, in order to validate your request. All of your Content will be immediately deleted (or disabled) from the Service upon cancellation, it is important that you take in mind that this information cannot be recovered/denied once your account is cancelled.

The Company, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Company service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. The Company reserves the right to refuse service to anyone for any reason at any time. Violation of any of the agreements present in this Terms will result in the termination of your Account.

The Company may remove content and accounts containing content that the Company determines in its sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Company customer, employee, member, or officer will result in immediate account termination.

- Disclosure of your registration data and information

Notwithstanding any other provision of these Terms, the Company reserves the right, but has no obligation, to disclose any information that you submit or that the Company discovers in performing the Service, if in its sole opinion, the Company suspects or has reason to suspect, that you are abusing the Service or that you have/are used/using fake, inaccurate, inappropriate or untrue information about You, or that you are involved in unethical activities, or that you are involved in any way in activities that violate any local, state, national or international law or regulation. Information may be disclosed to authorities that the Company, in its sole discretion, deems appropriate to handle such disclosure. Appropriate authorities may include, without limitation, law enforcement agencies, child protection agencies or court officials. You hereby acknowledge and agree that the Company is permitted to make such disclosure.

- Here is how and who handle your payments

All the payments are handled by "http://fastspring.com/" Bright Market, LLC d/b/a FastSpring solutions. All FastSpring solutions are secured by FastSpring's enterprise e-commerce infrastructure, which includes a proven payment gateway, advanced fraud prevention, 24x7 customer service and much more. You will not need to enter any information about your credit card or any other sensitive data in the Service or in our Websites to purchase a package, all the payment process is securely handled by our partner FastSpring. In the event that after you have purchased a plan, you have not received the queries/credits number you have purchased, you must immediately contact the Company by email to solve the issue, include the Order ID in the email message. You acknowledge that we can view the details of the orders, which include your name, surname, address, telephone, etc. If required and in case of payments higher than or equal to $500 USD we may support payment via wire transfer directly to our company. If required we can also support Purchase Orders (PO).

- Here is how we handle refunds for services and products

When you first register an account on our Service, you have 25 free API credits that you can use to fully test our Service, so you can decide to buy more API queries/credits only if our Service is what you are looking for and meets your needs. 

We do not provide a refund for purchased, unused or already utilized API queries/credits, or in case the Service has issues (of any kind) or it is shutdown. We do not offer a SLA and we do not guarantee the continuity of the Service, however we will do our best to keep the Service active, solve issues (if any) and improve its functionality.

In the event the Service will be shutdown, you will be notified via email at least 3 months (90 days) before its shutdown event, and during this time you will still be able to consume your credits but you must not buy more credits. Once the Service has been shutdown, the credits will be lost.

- Modifications of the service, packages and prices

The Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. The prices, products and pricing plan types of the Service, including but not limited to the queries/credits packages, are subject to change upon 30 (thirty) days notice from the Company. Such notice may be provided at any time by posting the changes to the Company site, or the Service itself or may be sent by email to the active and enabled registered users. The Company shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

- Intellectual property, copyrights and rights

Except with respect to the content, including Your content, you agree that the Company and its suppliers own all the rights, title and interest in the Sites, the Service, the Products, and the Company materials. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Sites, the Service or the Company materials. NoVirusThanks, NoVirusThanks Company Srl, the NoVirusThanks logo, and/or other NoVirusThanks products or services referenced herein are trademarks of NoVirusThanks Company Srl, may be registered in certain jurisdictions, and may not be used without permission in connection with any third party products or services. Other trademarks, service marks and trade names that may appear on the Sites or in connection with the Service are the property of their respective owners. 

- Reverse engineering, decompilation and disassembly

You are expressly prohibited from reverse engineer, exploit, hack, decompile, or disassemble the Service, the Sites or the Products in any case. You agree not to modify, adapt, hack, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or algorithms used in the Service, the Sites or the Products. Failure to do so may result in penal actions. You agree not to reproduce, duplicate, copy, sell, or resell any portion of the Service, use of the Service, or access to the Service without the express written permission by the Company. You refrain from any kind of activity that could damage, overload, harm the normal and correct functioning of the Service, the Sites or the Products provided by the Company. You undertakes to refrain from illicitly or fraudulently obtaining site contents or stealing or copying said contents. You agree to not observe, study or test the operation of the Service itself, the Sites or the Products, with the aim of determining the ideas and principles on which each of its/their elements are based.

- Technical support and technical processing

Technical support may be only provided to paying account holders and is only available via email. Support is only available in English and/or Italian language, we may ignore email messages wrote in different languages. Usually technical questions are answered within 3 business days, but you can re-send the message in case you have received no answer. We do not guarantee a reply to each message. You acknowledge, understand and accept that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You are responsible for what you write and what you send.

- The Service is provided on an "as is" and "as available" basis

Your use of the Service, the Sites and the Products is at your sole risk and you understand that the Service, the Sites, the Products is/are provided on an "as is" and "as available" basis with possible programming defects. The Company cannot be held responsible for damages or losses deriving from the use of the Service and/or of the Sites and/or of the Products. 

You expressely hold the Company harmless in the event that the Service and/or the Sites and/or the Products is/are compromised and You are infected by Internet threats and/or if sensitive information associated to You are stolen by the intruders and released publicly. We will do our best to maintain the Service, the Sites and the Products secure, but as everyone should understand in the today's digital world: there is no place, service or product that is 100% secure.

The Company does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service and of the sites will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected. 

You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service. You expressely hold the Company harmless in any possible event caused to you or to others by the usage of the Service, the Sites or the Products.

The Company is not responsible for web pages linked to the Service and to the Sites, and will not therefore be responsible for the contents present on any of such website. You browse such web pages expressely at your own risk, under their own terms, conditions and legal notices for which the Company is absolutely not responsible. You expressely hold the Company harmless in the event that the information present in the Service and in the Sites are incorrect, none of the information or content present on the Service and on the Sites should be considered as an indubitable fact.

You can not use the products, services, contents or tools provided by the Company in any way that could harm the antivirus industry/URL scanning-blocking industry or the security industry in general, whether it is directly or indirectly. You can not use the products, services, contents or tools provided by the Company to compare any kind of software, service or vendor, especially security software or URL-blocking services and software. You can not use the products, services, contents or tools provided by the Company in any way that could harm other users, other computers or other systems.

- We use cookies for web sessions and preferences

This website might store cookies on your computer, if allowed by your web browser's privacy settings (for more info on configuring your browser, check AboutCookies.org or read the docs of your browser). - Hosting partners and server locations

We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run our services and websites. You acknowledge and agree that your registration data, log files and other data (including your IP address, the web pages of our website that you have visited, the user-agent string) might be saved or might transit between these servers.

- Applicable law and place of jurisdiction

This agreement is governed by the laws of Italy and the only law applicable to this agreement is Italian law. Any dispute arising from this agreement and/or its interpretation shall be exclusive competence of the Tribunal of Perugia (Tribunale di Perugia), located in Italy, except in case of matters reserved to the jurisdiction of the Specialized Sections in Intellectual Property: in this case the only competent court will be Florence (Firenze), that is located in Italy.
